Troubled Waters: Constitutional issues in water regulation in the Murray Darling Basin

Adam will examine some of the constitutional issues surrounding water regulation within the Murray-Darling Basin.  In particular, he will discuss the recent Federal Court decision of Lee v Commonwealth [2014] FCA 432, a case in which irrigators in Victoria and South Australia challenged the validity of the Water Act 2007 (Cth) on the basis that the Act offended s 99 or s 100 of the Constitution or was contrary to the Melbourne Corporation principle.
