Progress with the EU/China Bilateral Investment Agreement

On 29-30 November 2016, EU Centre Advisory Board member Pascal Kerneis, accompanied by the Director of the EU Centre for Global Affairs, Jane Drake-Brockman, participated in the 2nd Asia FDI Forum “China’s Investment Three-Prong Strategy: Bilateral, Regional, and Global” hosted by the Chinese University of Hong Kong Law School.

The EU is currently negotiating a Bilateral Investment Agreement (BIA) with China, including provisions on Investor State Dispute Settlement (ISDS) that refer to the EC’s proposed new Court for ISDS. Presentations outlining progress to date on the EU/China BIA are available to download, along with a presentation by Sophie Meunier of Princeton University on the history and latest contentious developments with respect to the EU mandate, dating from the Lisbon Treaty, but increasingly under fire especially since CETA, on Foreign Direct Investment.
