International Implications of Military Space Operations

Professor Dale Stephens has recently been published in the US Naval War College Journal of International Law Studies.

 

The article; ‘The International Legal Implications of Military Space Operations: Examining the Interplay between International Humanitarian Law and the Outer Space Legal Regime’ considers the interplay between the Outer Space Treaty and International Humanitarian Law. It invokes normal mechanisms of interpretation to achieve harmonization and canvasses the efficacy of these mechanisms, which don’t always deliver sustainable outcomes. Ultimately it concludes that where such mechanisms are unable to achieve the necessary harmonization, then a stark policy choice needs to be made and it offers a framework for how such choices might be made.
